"INTERN DESK" AND "ASSESSMENT DESK" AND "FUNDED BROKERAGE"
The Intern Desk, The Assessment Desk, and other simulated accounts offered by The Futures Desk provide users with the opportunity to practice trading in a risk-free, simulated market environment. The privacy practices outlined in this section, in conjunction with the rest of this Privacy Notice, apply to you if you maintain an account within any of these programs.
Simulated Trade Data
We will track data related to your simulated trades, including but not limited to the volume, types, value, returns, and patterns of success or failure. This information may be combined with simulated trade data from other users, and potentially with non-simulated trade data, as permissible under applicable law. By engaging in simulated trading, you acknowledge that The Futures Desk may collect, aggregate, and utilize information about your specific simulated trades, trading patterns, preferences, and other interests at its sole discretion. This data analysis aids in refining our services and providing a more tailored experience, always in compliance with applicable regulations.
Analyzing Funded Opportunities
We will analyze your simulated trading data (as described above) and other Collected Information associated with your account to assess your potential eligibility for additional TFD Services.
Aggregate Data and Deidentified Data
As outlined in the "How We Use and Share Collected Information" section of this Privacy Notice, The Futures Desk collects, aggregates, or de-identifies Collected Information, encompassing data related to you and your simulated trades, trading patterns, preferences, and other interests expressed while using our Services. The Futures Desk may share or disclose this anonymized and aggregated information with its business partners, affiliates, subsidiaries, related companies, users, customers, vendors, distributors, or other collaborators. They may use this information to inform their own trading activities, potentially including mirroring or counter-trading simulated trades in actual financial markets, or for any other lawful purpose. You acknowledge that such activities may be automated and that you are not entitled to any payment or compensation. The Futures Desk will ensure that anonymized and aggregated information remains in that form and will not be re-identified except as necessary to comply with legal requirements.
FUNDED / BROKERAGE ACCOUNTS
Based on your performance during your internship, or while trading for the desk, as a research analyst, or such other simulated accounts that The Futures Desk may offer from time to time—and at The Futures Desk's sole discretion—you may have an opportunity to get funded with trading capital via Evolved Capital LLC or to advance to another product or service offered by The Futures Desk. This section, in addition to the rest of this Privacy Notice, applies to you if you hold a funded account through our partnered brokerage services.
Funded Brokerage Traders
When you apply for live funded accounts or other funding opportunities through The Futures Desk LLC, in addition to the information outlined in this Privacy Notice, we may collect the following:
- Full Legal Name: Your complete legal name, including first, middle, and last names.
- Date of Birth: To confirm your age and eligibility.
- Government-Issued Identification: This may include a copy of your driver's license, passport, or other government-issued photo identification, which may also capture your Social Security Number.
- Photographs: A photograph of yourself and images of your government-issued identification for verification purposes.
- Contact Information: This encompasses your telephone number, email address, physical mailing address, and country of residence.
- Additional Information: Any other information you willingly provide to The Futures Desk or Evolved Capital LLC during the registration or application process.
Beyond the uses detailed in the "How We Use and Share Your Information" section, the information we gather for funded opportunities may also be utilized for purposes such as:
Managing Trader Relationships - The Futures Desk LLC may process your personal information for the purpose of managing your trader relationship. This includes activities such as determining your eligibility for a funded brokerage account or contract, verifying your qualifications, identifying you, communicating with you, determining performance requirements, assessing your performance, gathering evidence for disciplinary actions (including termination of your live brokerage account), and conducting data analytics and other related statistics;
Timekeeping and Access - To verify your identity for timekeeping purposes; to facilitate your access to The Futures Desk Services, facilities and/or premises;
Administration of Payouts - To administer payouts in accordance with the Terms and your agreement with us;
Safety and Security - To comply with laws, rules, or regulations; when, in The Futures Desk's judgment, disclosure is necessary to prevent fraud or to comply with any statute, law, rule or regulation of any governmental authority or any order of any court of competent jurisdiction; to ensure network and information security, including preventing unauthorized access to our computer and electronic communications systems and preventing malicious software or code distribution;
Legitimate Business Purposes
To provide and operate The Futures Desk's business processes, systems and business operations (e.g., work assignments, management of The Future Desk's property, and safety and protection of TFD employees and independent contractors, directors, owners, agents, assets, resources, properties and facilities); when The Futures Desk outsources some or all of its operations to third party service providers who provide services for The Futures Desk ; to third parties engaged by TFD and serving in an agency capacity to perform functions on behalf of The Futures Desk, the performance of legal and other professional services; to enforce or apply The Futures Desk's contract with you and any TFD policies and agreements; to support internal administration with our affiliates, subsidiaries and related companies;
Performance Review
The Futures Desk LLC may also monitor and record your overall performance (or specific details thereof) associated with your funded brokerage account or any other funded opportunities that The Futures Desk may offer you periodically. This tracking is essential for evaluating your progress and determining your eligibility for continued participation in such programs.
Sensitive Personal Information
In certain jurisdictions, specific categories of personal information are considered particularly sensitive and may be afforded additional protections under applicable law. As previously mentioned in this Privacy Notice, we may collect and process sensitive personal information such as your Social Security Number, passport details, or other government identification information.

The Desk and the Watercooler
When you join a special "DESK" or "WATERCOOLER" group, your personal information—such as your first and last name, username, and location from which you are trading from (e.g., city, state, etc.), and other contract information (e.g., email)—will be shared with your teammates and your team's captain or captains.

User Activity
